As a buyer, you don’t have to pay your real estate agent or broker in Colorado. Why is that, because the seller is responsible for paying your agent or broker? It is important that you employ someone that listens to what you want. If you go through the listing agent, they usually represent the seller and look out exclusively for the seller’s interests. That is why I recommend you employing a buyer broker by signing an exclusive buyer’s agent agreement. Without the agreement, the agent or broker can not represent you as a buyer’s broker in the state of Colorado. With the agreement, you know for sure that the agent or broker is representing you and your interests and is liable to do so by law. The agreement also allows the buyer broker to put the word out and use his or her connections to find you the best property that fits your needs.
A buyer broker will look at all listings that meet your criteria, not just push their or their office listings. Also, a buyer broker will want to get you the best price possible and will tell you to make a lower offer first because you can always raise the offer from there. A Buyer Broker will then also review all the terms of the offer with you. It is important that the buyer understands all of their rights when they sign the purchase contract. A buyer broker does want to make sure that everything is straightforward and honest going forward with the offer.
Most Aspen and Snowmass real estate agents or brokers are transaction brokers or selling brokers. Transaction brokers represent no ones interests and only look out for putting the deal together themselves. Transaction brokers by Colorado law do not have any liability to the seller or buyer. So, why would a buyer want to buy a property from a transaction broker or selling agent? Who represents the buyer? No one, unless you have a buyer broker working for you.
